1. Scope and provider

These Terms & Conditions ("Terms") govern the use of the online game Pirates Empire, its launcher, its website piratesempire.net and every service offered with them (together the "Game"). The Game is provided by Pirates Empire, Nagymező u. 41, 1065 Budapest, Hungary, e-mail [email protected] ("we", "us"). By creating an account you accept these Terms.

2. Your account

• You must be at least 13 years old to play. If you are under the age of majority in your country, you may only play, and in particular only buy anything, with the consent of a parent or guardian.
• Give a real e-mail address that is yours. You need it to verify your account and to reset your password.
• Keep your password secret. You are responsible for what happens with your account. Tell us at once if you think someone else uses it.
• Accounts are personal. Selling, buying, trading, renting or giving away accounts is not allowed.
• Your captain's name must not insult, discriminate, impersonate others (including our staff) or break the law. We may change such a name.

3. Rules of the game

Play fair and treat others with respect. In particular it is not allowed to:

• use cheats, bots, macros, modified game files, or any program that changes, automates or reads the Game in a way not intended by us;
• exploit bugs or errors - please report them to us instead;
• use several accounts to gain an unfair advantage, or to push items, currency or rankings from one account to another;
• buy or sell accounts, virtual items or virtual currency for real money or anything outside the Game;
• insult, harass, threaten or discriminate against other players, spam, advertise, or post illegal content;
• disturb the servers or other players' connections, or try to get into accounts or systems that are not yours;
• pretend to be a member of our staff.

4. Virtual items and currency

Gold, pearls, crystals, items, ships, Premium and every other virtual content of the Game are part of the Game. You receive a personal, non-transferable, revocable right to use them in the Game; they are not your property, have no monetary value and cannot be exchanged for real money. We may change the Game's content, balance and economy to keep it fair and fun.

5. Paid offers

• The Game is free to play. Some content (for example pearls or Premium) can be bought for real money.
• The price, including VAT, and what you receive are shown before you buy. The contract is concluded when you complete the order.
• Payments are processed by the payment provider shown at checkout; their terms apply to the payment itself.
• Bought content is delivered to your account straight away. Premium bought for a period ends by itself at the end of that period; nothing renews automatically.
• About your right of withdrawal, see Withdraw Contract below.

6. Availability and changes

We do our best to keep the Game available, but we cannot promise that it runs without interruption. The servers restart daily and are sometimes closed for maintenance and updates. We may develop, change or end parts of the Game. If we close the Game for good, we tell you at least 30 days before.

7. Measures against rule breaking

If you break these Terms we may, depending on how serious it is: warn you, mute you in the chat, remove virtual items or currency gained by the breach, block your account for a time or for good. You are told the reason when you try to log in. For a ban for a serious breach there is no refund of virtual content, unless the law gives you one. If you think a measure is wrong, contact us.

8. Ending the contract

You can end your contract at any time by asking us to delete your account (see Cancel Subscription). We can end it with 30 days' notice, or at once for an important reason such as a serious or repeated breach of these Terms.

9. Liability

We are liable without limit for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of essential contractual duties, and only for the typical, foreseeable damage. Any liability under mandatory consumer protection law remains unaffected.

10. Changes to these Terms

We may change these Terms for valid reasons (for example new features or a change in the law). We tell you about changes at least 30 days before they apply, on the website and in the Game. If you keep playing after that date, the new Terms apply; if you do not agree, you can end the contract.

11. Applicable law and disputes

Hungarian law applies. If you are a consumer, this does not take away the protection given to you by the mandatory law of the country where you live. As a consumer you may also turn to the Budapest Conciliation Board (Budapesti Békéltető Testület) or to the conciliation board of your place of residence. We are not obliged and not willing to take part in dispute settlement before a consumer arbitration board, unless the law requires it.

Data Privacy Policy

1. Who is responsible

The controller under the EU General Data Protection Regulation (GDPR) is Pirates Empire, Nagymező u. 41, 1065 Budapest, Hungary, [email protected]. Write to this address for anything about your data.

2. What data we collect

Data collected automatically

When you visit our website, your browser sends technical data to our servers by itself. This is recorded in log files:

• the IP address of your device and the country derived from it,
• date and time of the request,
• the page or file requested, and whether the request succeeded,
• the amount of data transferred,
• your browser and operating system (as your browser reports them) and the page you came from.

When you use the launcher or the game, the following is recorded: the IP address and country of your connection, the time of your login and of each connection (the last 25 per account), and records of suspicious activity found by our anti-cheat checks.

Your account

When you register: your captain's name, your e-mail address, your password (we store it only as a salted hash - nobody can read it, not even we), the date of registration, whether your e-mail is verified and when you accepted these terms.

To protect the registration against automated abuse (accounts made by scripts), the registration form runs an automatic check in the background: for this, technical data of your browser and of how the page is used are processed by our security provider. It only tells us whether the registration comes from a person.

Use of the game

While you play: your game progress and saves (ship, level, items, currencies, guild), rankings and statistics, your game logbook, in-game mails, and your communication - the messages you write in the chat, and reports you send or receive.

Purchases

If you buy paid content: what you bought, when, the price and the status of the payment. Your payment details themselves (for example card or PayPal data) are entered at and processed by the payment provider; we do not receive or store them.

Contact and support

If you write to us by e-mail or on our Discord: your name or captain's name, e-mail address, the date and the content of your message - only to answer you.

E-mails

We send you only the mails your account needs: the mail to verify your e-mail address and, when you ask for it, the mail to reset your password. We send no newsletters and no advertising.

3. Why we use your data

• To provide the game and your account, and to fulfil purchases (Art. 6(1)(b) GDPR).
• To protect the game and its players against cheating, abuse, fraud and attacks, and to moderate the chat (Art. 6(1)(f) GDPR - our legitimate interest in a safe and fair game).
• To keep the records that tax and accounting law requires (Art. 6(1)(c) GDPR).

We do not sell your data, do not use it for advertising and do not create profiles of you.

4. Who receives data

To run the game we use carefully chosen service providers, who process data only on our behalf and on our instructions: providers for hosting our servers, for delivering and protecting the website, for sending e-mails, for storing backups, and for processing payments. Your data is not passed on to anyone else, unless the law obliges us to.

Some of these providers process data outside the European Union. In that case the data is protected by an adequacy decision of the European Commission or by the EU Standard Contractual Clauses. If you contact us on Discord, Discord's own privacy policy applies to what you send there.

5. How long we keep data

• Account and game data: as long as your account exists. When it is deleted, they are deleted too.
• Logbook: the latest 5,000 entries per account. Connection history: the latest 25 connections per account.
• Saved copies of your ship (to undo errors): up to 7 days. Database backups: 14 days.
• Chat lines in the moderation view: only in memory, the last 300 lines. Server logs (which can contain IP addresses and chat lines): at most 30 days.
• Handled reports: 180 days. Password reset links: 30 minutes. E-mail verification links: 7 days.
• Payment and accounting records: as long as tax law requires (in Hungary up to 8 years).

6. Children

The Game is for players aged 13 and older. In Hungary, consent for online services can only be given by yourself from the age of 16; if you are younger, a parent or guardian must agree to your account and to any purchase.

7. Your rights

You have the right to access your data, to have it corrected or deleted, to restrict its processing, to receive it in a portable format, and to object to processing based on our legitimate interests. Write to [email protected] from the e-mail address of your account. You also have the right to complain to a data protection authority - in Hungary the Nemzeti Adatvédelmi és Információszabadság Hatóság (NAIH), Falk Miksa utca 9-11, 1055 Budapest, or the authority of your country.

8. Security

All connections are encrypted (HTTPS/TLS). Passwords are stored only as hashes. Session tokens and links are stored only as hashes and expire. Our administrators need a second factor (an authenticator app) to log in, and every administrative action is logged.

9. Cookies

See Cookie Settings: we set no cookies and use no tracking or advertising.

10. Changes

We update this policy when the Game or the law changes. The current version is always on this page.

Cancel Subscription

Pirates Empire has no automatically renewing subscriptions. Premium is bought for a fixed period and ends by itself when the period is over - there is nothing to cancel and nothing is charged again.

To close your account (and end your contract with us), write to [email protected] from the e-mail address of your account, with your captain's name. We delete the account and its data, apart from what we must keep by law. A deleted account cannot be restored, and its virtual items and currency are lost.

Withdraw Contract

Right of withdrawal

If you are a consumer, you have the right to withdraw from a purchase within 14 days without giving any reason. The withdrawal period ends 14 days after the day the contract was concluded.

To exercise it, tell us (Pirates Empire, Nagymező u. 41, 1065 Budapest, Hungary, [email protected]) by a clear statement, for example by e-mail, that you withdraw. You can use the model form below, but you do not have to. It is enough to send your statement before the period ends.

Effects of withdrawal

If you withdraw, we refund all payments received from you without undue delay and at the latest within 14 days of receiving your withdrawal, using the same means of payment you used, unless agreed otherwise. You are not charged any fees for this refund.

When the right of withdrawal ends early

For digital content that is not on a physical medium (for example pearls or Premium), the right of withdrawal ends as soon as we start delivering it, if you expressly agreed that delivery starts before the withdrawal period is over, and confirmed that you know you lose your right of withdrawal by this. You are asked for this consent and confirmation before you buy.

Cookie Settings

This website sets no cookies and uses no tracking. Only your language choice is kept in your browser, and your login only while the tab is open.

Technically: the chosen language is kept in your browser's local storage; your website login and a random page number for the "Online now" count are kept in the tab's session storage and disappear when you close the tab. Nothing is used for advertising or profiling, so there is nothing to switch on or off.
